There is a pervasive knowledge gap in the area of white-collar defense, and too often, this lack of knowledge leads to defendants being overcharged and receiving harsh custodial sentences. Indeed, many nationally recognized white-collar defense attorneys should not be handling white-collar cases. After all, it is the client that suffers the consequences, not their lawyer. We can square that knowledge short-fall by unpacking the complex areas of securities litigation and presenting the material (often the government’s theory of criminality) in a way that generalist attorneys can synthesize and thus help their clients obtain better outcomes. With that said, we are sensitive that attorneys, particularly young lawyers and those with decades of experience, are reluctant to engage in help because of reputational fear.
